It is inconceivable that the DNC would have consented to CNN's use last night of the audio feed from the Convention's director/producer (Don Mischer). The DNC would have nothing to gain and everything to lose by allowing this. Even if the balloon drop had gone correctly, Mischer clearly did not sound like someone who knew he was on live TV. Nevertheless, it would be great to hear from the DNC that CNN intercepted the audio feed and used it without the DNC's consent.
Since CNN's conduct is so eggregious, DNC can sue CNN for punitive damages in MA (see Mass. Gen. L. ch. 272, sec. 99; there's also 18 USC sec. 2511, but MA will probably be a better forum).
Imagine the contortions CNN would have to go through in order to report on the Democrats fairly. Any snide remark, or repetition of RNC talking points, could be seen as retaliatory conduct in litigation, subject to contempt of court. Can you picture a MA state court judge setting FAIR AND BALANCED standards for CNN reporting during the course of this litigation?
